The evolution of the SALW and CA in Tajikistan began in 2004 when the Government has addressed OSCE to provide support in ensuring physical security of country’s arms and ammunition stockpiles, as well as in destruction of surplus amounts of small arms and light weapons (SALW&CA). By the time of ExB project completion in 2009, tens of tons of ammunition and some 30 000 pieces of small arms were destructed, national capacity for SALW&CA destruction created, more than 60 storage facilities built/renovated throughout the country for all law-enforcement agencies involved in implementation of the programme.
The UB project that followed in 2009 had a two-folds approach: first - to create national training capacity on SALW and CA physical security and stockpiles management, and the second – to elaborate and amend national legislation on incidents response, in order to have a coordination mechanism in place when incidents related to the use of SALW and CA occur.Tajikistanwas the first country in the region, where efforts on establishment of such a mechanism were discussed and planned for implementation by the OSCE.
Amendment of SALW&CA guidance documents
Within 2010 - 11, a working group from representatives of national law enforcement agencies has been established, with the aim to amend and improve the existing training modules/executive directives on SALW&CA stockpiles management and bring them in full compliance with the OSCE Best Practices on SALW&CA. As the first priority, the group has reviewed and amended guiding documents on SALW&CA physical security, adding important sections on transportation and handling of known type of arms and ammunition. The activity was completed by the end of 2011.
In 2012 the Office continues to improve capacities of Tajik law enforcement agencies through provision of amended training modules, based on international standards and the OSCE best practices on SALW&CA.
Council on Incidents Response
In order to respond to incidents related to the use of SALW&CA, and to support the country in establishment of a unique coordination mechanism on SALW&CA incidents response, the Office in 2010 gathered experts from all relevant agencies of the country in a working group; Based on review of related documents, the group initiated elaboration of a document on creation of a Council on incidents response, which would serve as a coherent mechanism to coordinate responsive actions to SALW&CA – related incidents. As a result, Government of the country issued a resolution #230 in April 2011, on “Creation of a council for responding to SALW&CA-related incidents”.
The final goal to achieve is to have an entity, provided with a variety of functions, not limited to incidents response, but also training and assessment capacities, which will ensure stability of situation with arms and ammunition in the country.
Confidence and security building measures
In 2003 the Government of Tajikistan officially requested the OSCE to assist in developing projects in the area of promotion of Confidence and Security Building Measures.


Police Reform Steering Working Group

The Police Reform Steering Working Group (hereinafter - SWG) is established in accordance with Article 2 “The MoU implementation mechanism” of the Memorandum of Understanding (hereinafter MoU) on Police Reform between the Government of the Republic of Tajikistan and the OSCE.
In accordance with Annex 1 to the MoU, the SWG consists of the Steering Group (SG - political level), and of the Permanent Working Group (PWG).
The Steering Group includes:
- Deputy Minister of Internal Affairs
- Head/Deputy Head of the OSCE Office in Tajikistan;
- Representative of Executive Office of the President of Tajikistan;
- Counter Terrorism and Police Adviser of the OSCe Office in Tajikistan;
- Representative of the European Commission’s Office in Tajikistan;
- National Coordinator;
- In accordance with the MoU, on the proposal of the Head of the OSCE Office in Tajikistan (OiT) or donor states, the SWG has also included representatives of other international organizations and embassies: the embassies of the USA, Germany, France, Great Britain, Russian Federation and Kazakhstan.
The Permanent Working Group consists of:
- Deputy Minister of Internal Affairs;
- Heads of key departments of the MIA;
- Head of Politico-Military Department of the OSCE OiT;
- Counter Terrorism and Police Adviser of the OSCE OiT;
- Representatives of key donors;
- National Coordinator.
The Minister of Internal Affairs performs the overall management of the SWG, the First Deputy Minister of Internal Affairs, who is personally responsible for implementation of the tasks imposed on the group, directly manages and oversees the activities of the SWG.
The first organizational meeting of the SWG was conducted on 26 September 2011, where the Provision of the Police Reform Steering Working Group (PRSWG) was approved.
In accordance with the Provision, the main objective of the SWG is to draft the Police Reform Strategy and Police Reform and Development Program, as well as to prepare suggestions and analytical materials for them.
Moreover, the SWG must coordinate the drafts of the Strategy and the "Program" with the ministries and agencies of the Republic of Tajikistan and to develop a legal regulatory act to follow internal procedures for their approval.
The SWG members are also involved in the preparation of analytical materials and proposals for other projects related to police reform and development issues in order to review them on the meetings by the SWG and PWG. They are also in charge of preparing the suggestions to create Working Sub-Groups (WSG) for effective activity of the PWG and for effective implementation of separate projects under the Police Reform and Development Program.

Police Reform (Development) Program for 2014-2020

On 3 May 2014 the Government of the Republic of Tajikistan has approved the Police Reform Program (Development) for 2014-2020 (hereinafter - the Program).
In accordance with the Decree of the Government of the Republic of Tajikistan from 3 May 2014, No.296 the relevant ministries and agencies, executive bodies of governmental authorities of the Gorno - Badakhshan Autonomous Region, regions, Dushanbe city, cities and districts, other organizations and institutions were entrusted with ensuring the implementation of the Program. The Ministry of Internal Affairs shall annually submit a report to the Government of the Republic of Tajikistan on the progress of its implementation.
The Police Reform Program, being a fundamental mid-term program document, defines the strategic goals, objectives and key areas of police reform (development). The Program is developed by the Ministry of Internal Affairs of the Republic of Tajikistan (hereinafter - the Ministry of Internal Affairs) on the basis of Article 7 of the Law of the Republic of Tajikistan "On the state forecasts, concepts, strategies and programs for socio-economic development of the Republic of Tajikistan," the National Development Strategy of the Republic of Tajikistan for the period up to 2015, approved by the Decision of Majlisi Namoyandagon of Majlisi Oli of the Republic of Tajikistan from 28 June 2007, No.704 and the Police Reform Strategy for 2013-2020 (hereinafter - the Strategy), approved by the Decree of the President of the Republic of Tajikistan on 19 March 2014, No.1438.
The progress of the Program’s Action Plan is implemented in collaboration with the Government of the Republic of Tajikistan, the Organization for Security and Cooperation in Europe, Office in Tajikistan (hereinafter - OSCE Office in Tajikistan) and donor countries.
The Police Reform should be a first step, which will be amended and improved by proportionate changes in the work of other law enforcement and judicial authorities.

Police Reform Strategy of Tajikistan

The Police Reform Strategy in Tajikistan until 2020 (Strategy) is a document, which defines the state policy on combating crime. It reflects the actions that will be implemented by the Government of Tajikistan in a mid-term on police reforming and development of Tajikistan.
The Strategy is developed by national experts in co-operation with the Organization for Security and Cooperation in Europe (OSCE) Office in Tajikistan based on the Joint Needs Assessment of the Ministry of Internal Affairs (MIA) of Tajikistan, carried out by the OSCE assessment team in 2008, as well as based on the “Police Reform Assessment” workshop, conducted from 9 to 20 November 2009.
The Strategy is aimed at the identification of goals, priorities and measures on Police Reforming and Development, the implementation of which facilitates the solution of crucial tasks of socio-economic development of Tajikistan in the modern era, and meets the basic priorities of the National Development Strategy of Tajikistan for the period until 2015.
The Strategy represents a completely new approach to developing of internal affairs agencies of Tajikistan, taking into consideration the world practice on development and implementation of similar strategic documents, lessons and conclusions of past phases of Police Development, as well as the current realities and perspectives of its development.
The Strategy will be implemented in accordance with the Program (Strategy) of Police Development Perspectives, with the participation of the following stakeholders: the Government of the Republic of Tajikistan, internal affairs agencies, civil society institutes, the population of Tajikistan, and international organizations with donor-states.
The Strategy takes into account and envisages the reforms, occurring in the key areas of the society and the state vital activity.

Law on Police

In accordance with the Police Reform Strategy for 2013 - 2020, which is approved by the Decree of the President of the Republic of Tajikistan on 19 March 2013, No.1438, the Police Reform process shall be transparent and public.
It assumes creation of various mechanisms that support open and public discussions during the entire police reform period. The discussion and decision-making format shall enable the citizens to take direct and indirect participation in the discussion of the reform progress at its different stages, to have an opportunity to convey their requests (expectations) and suggestions on this issue to the Government of the Republic of Tajikistan, and to have a possibility to monitor the records of public requests to the Police Reform.
The Reform anticipates the stipulated phasing, indicating the timelines and expected outcomes. The first stage includes drafting the Law of the Republic of Tajikistan “On Police,” the adoption of which within a short time will entail changes in the police name, in the definition of the police main duties and tasks and in the personnel policy.
In this regard, the Working Group of the Ministry of Internal Affairs of the Republic of Tajikistan has elaborated a Draft Law of the Republic of Tajikistan “On Police,” which is posted on the MIA website on 20 May 2014.
Taking into account the Strategy requirements about openness and publicity of the police reforming process, the OSCE Office in Tajikistan has prepared an unofficial translation of the draft Law “On Police” into Russian, which will be placed along with the Tajik version on the “police-reform.tj” website.
We ask all Civil Society representatives in Tajikistan, professionals and experts, human rights defenders to be actively involved in the process of the Draft Law preparation and discussion, which further will determine the entire course of Police Reform in Tajikistan.
